These Terms and Conditions apply to Be Your Best Self, a trading name of Heather Todd (sole trader), based in New Zealand.

These Terms and Conditions (“Terms”) govern your access to and use of the Be Your Best Self website and services operated by Be Your Best Self (“we”, “us”, or “our”).

By accessing this website or using our services, you agree to be bound by these Terms. If you do not agree, please do not use the website or services.

Our services

Be Your Best Self provides counselling, therapy, wellbeing support, and educational services, which may include:

  • counselling and therapy sessions
  • online counselling sessions
  • workshops and group sessions
  • memberships and community-based offerings
  • informational and educational content via this website

Some services are therapeutic in nature, while others are educational or supportive. Participation in any service is voluntary.

No medical or crisis services

The information provided on this website and through our services is not a substitute for medical care, psychiatric treatment, diagnosis, or emergency services.

If you are experiencing a mental health crisis, are at risk of harm to yourself or others, or require urgent support, please contact local emergency services or a qualified healthcare provider immediately.

Counselling and therapy disclaimer

Counselling and therapy are collaborative processes. While many people experience positive change, outcomes vary, and specific results cannot be guaranteed.

You remain responsible for your own decisions, actions, and wellbeing.

Bookings and payments

Bookings may be made through our online booking system, contact forms, email, or manual arrangement.

Payments are accepted via:

  • bank transfer
  • Stripe
  • PayPal (for international clients)
  • Wise (for international clients)

Specific details regarding fees, session length, cancellations, and rescheduling are provided at the time of booking or in booking-related communications.

Workshops and group sessions (refunds and cancellations)

Workshops and group sessions have limited spaces and require advance preparation. A place is reserved specifically for you once your registration is confirmed.

  • Cancellations made more than 7 days before the workshop or group session start date may be eligible for a refund.
  • Cancellations made within 7 days of the start date are not refundable, except where a remedy is required under the Consumer Guarantees Act 1993.
  • Where possible, we may offer the option to transfer your registration to a future workshop, at our discretion.

Memberships (billing, cancellation and refunds)

Membership fees are charged on a recurring monthly basis and provide access for the relevant billing month.

You may cancel your membership at any time. If you cancel:

  • you will not receive a refund for the current billing month, and
  • you will not be charged again for any future months.

Your access will continue until the end of the current billing month, unless otherwise stated.

Membership fees are non-refundable once a billing period has commenced, except where a remedy is required under the Consumer Guarantees Act 1993.

Community participation and conduct

Some memberships or services include access to community spaces such as forums, group discussions, or live group sessions. These spaces are intended to be respectful, supportive, and safe for all participants.

We reserve the right to remove or restrict access to community spaces or group sessions if a participant’s behaviour is disruptive, disrespectful, or inconsistent with the purpose or values of the group.

Where access is restricted for this reason:

  • membership fees for the current billing period are not refundable, and
  • access to other membership materials may continue at our discretion.

This clause is intended to protect the wellbeing of the group as a whole.

Intellectual property

All original content on this website and within our services, including text, written materials, and original resources, is the intellectual property of Be Your Best Self, unless otherwise stated.

Some images, graphics, and design elements are created using or licensed from third-party platforms, including Canva and Midjourney, and are used in accordance with their respective licence terms.

You are welcome to download, print, and use resources such as tapping charts for your personal, non-commercial use.

You may not copy, reproduce, distribute, sell, or share any content publicly or for commercial purposes without prior written permission.

Links to third-party websites

This website may contain links to third-party websites or services. We are not responsible for the content, terms, or privacy practices of those sites.

Access to third-party websites is at your own discretion and risk.

Consumer Guarantees Act

Our services are provided in accordance with the Consumer Guarantees Act 1993 (NZ).
Nothing in these Terms is intended to limit or exclude your rights under that Act.

Limitation of liability

To the extent permitted by New Zealand law, Be Your Best Self will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of the website or services.

Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act or other applicable New Zealand legislation.

Termination

We reserve the right to suspend or terminate access to the website, services, or community spaces where these Terms are breached or where continued participation is not appropriate.

Governing law

These Terms are governed by and construed in accordance with the laws of New Zealand.

Changes to these Terms

We may update these Terms from time to time. The most current version will always be available on our website.

By continuing to use the website or services after changes are published, you agree to the updated Terms.
